1. Acceptance of Terms

By accessing the https://www.eij.ca/en and https://www.eij.ca/en/shop websites, you agree to be bound by these terms and conditions. If you disagree with any provisions, please do not use the site. No additions or modifications to the terms and conditions are binding on Équipements Industriels (Joliette) inc. unless agreed to in writing. The processing of an order does not mean that Équipements Industriels (Joliette) inc. accepts any additional terms or conditions.

2. Authorized use of the site

The site is intended for persons aged 18 and over. You are prohibited from using it for illegal or fraudulent purposes or in a manner that infringes on EIJ's intellectual property rights. Équipements Industriels (Joliette) inc. agrees to sell only to businesses. The products are for commercial use only. Our products are designed for industrial use or for work by businesses and professionals.

3. Orders and payment

By placing an order:

• You agree to provide accurate, complete, and up-to-date information;
• Prices, taxes, and shipping costs are displayed in Canadian dollars;
• Payment is made through a PCI-DSS compliant provider;
• A minimum amount of $25 is required to proceed with your order;
• Payment terms: Net 30 days;
• A slow interest rate of 24% calculated monthly is applicable on all unpaid invoices.
• Default of payment: Payment of any unpaid invoice will be due 30 days after the invoice is issued to the customer. If collection or legal fees are incurred to collect these debts, a fee of 20% of the total amount due as liquidated damages will be charged to the customer.

4. Delivery and return policy

• Estimated delivery time at the time of order depending on product availability. This delivery time will be confirmed on your order confirmation.
• Delivery is free for purchases of $300 or more (before taxes), or shipping costs of $25 will be charged on the invoice. Certain exceptional circumstances may result in additional charges.
• Returns must be made within 30 days of purchase. Only undamaged merchandise in its original packaging may be returned. Shipping and return fees may apply.
• Customer error: For orders valued at less than $100, a $50 return fee will be charged. For orders valued at more than $100, a 25% return fee will be charged.
• This policy does not apply if the error, upon presentation of supporting documentation, is attributable to EIJ.
• Losses and/or damaged products during delivery, postage paid are the responsibility of EIJ unless these deliveries are made by your carrier. All non-conformities must be reported to our team within 24 hours of receipt of the goods.
• For packages damaged by the carrier, you must report any damage to the carrier at the time of delivery and note it on the delivery slip; otherwise, no recourse will be possible on the part of EIJ.
• Damaged items must be accompanied by a signed acknowledgment of receipt attesting to the damage.
• Following your complaint, we will send you instructions regarding your claim.
• All special orders cannot be returned or cancelled.
• Please contact customer service at any time to obtain a return authorization number (RMA #). If you have any questions, please do not hesitate to contact us.
• No refunds will be given for subjective reasons (change of mind), except where legally required.

5. Product availability

All products are offered subject to availability. EIJ reserves the right to cancel an order if an item is out of stock. Delivery is estimated at the time of ordering based on product availability. This delivery time will be confirmed on your order confirmation.

6. Limited warranty

The products are warranted against defects and manufacturing faults in accordance with the manufacturer's warranty. If EIJ determines that the product has a defect or manufacturing fault, it will be repaired or replaced at EIJ's discretion, which will constitute the buyer's sole remedy.

7. Intellectual Property

All content on the site (text, images, trademarks, and logos) is protected by intellectual property laws. Any unauthorized use is prohibited.

8. Limitation of Liability

EIJ shall not be liable for any indirect, incidental, or punitive damages arising out of the use of the site or the inability to use it.

9. Privacy Policy

The collection, use, and protection of personal information are governed by our Privacy Policy.

10. Modification of Terms

EIJ may modify these terms at any time. In the event of a significant change, a notice will be posted on the site or sent by email.

11. Applicable Law and Jurisdiction

The parties agree that, for any lawsuit or dispute under this contract and for the performance of all obligations mentioned herein, the parties will elect a domicile in the judicial district of Joliette, province of Quebec, Canada, and, consequently, the customer waives any rights they may have with respect to the jurisdiction of the courts of any other district.
